State Federal Consistency Lists
State federal consistency lists identify the Federal agency, Federal license or permit, and Federal financial assistance activities that are subject to federal consistency review if the activity occurs inside the state’s coastal zone, and pursuant to the requirements of the applicable subparts of 15 C.F.R. part 930.
For Federal license or permit and Federal financial assistance activities, such activities are also subject to federal consistency review if the activity occurs outside of the state’s coastal zone but within a geographic location description (GLD). A GLD encompasses the area in which an activity would have reasonably foreseeable coastal effects. For activities outside of a state’s coastal zone to be automatically subject to federal consistency review, the state federal consistency list must identify the activity and its associated GLD.
For Federal agency activities, whether proposed inside or outside the coastal zone, the Federal agency determines if coastal effects are reasonably foreseeable and the listed/unlisted provisions in NOAA’s regulations are recommended procedures for facilitating state-federal coordination. Whether or not an activity is listed, Federal agencies provide states with Consistency Determinations (CDs) for Federal agency activities affecting any coastal use or resource. Likewise, even if a Federal agency activity is listed, a federal agency may determine that coastal effects are not reasonable foreseeable and may provide a state with a negative determination.
